1. Acceptance of Terms

By accessing or using CutLand (the "Service"), including the website at cutland.ai and the CutLand mobile applications, provided by Wisenux Inc. ("Company", "we", "us"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

CutLand is an AI-powered video editing application that helps users import media, edit on an advanced timeline, generate AI short clips, create and refine subtitles, produce dubbing and text-to-speech voiceovers, apply visual effects and filters, use picture-in-picture and sticker overlays, design cover images, and export finished videos with Pro controls. Certain features may require a subscription, credits, or an internet connection.

3. Eligibility

You must be at least 13 years of age to use CutLand (or the minimum age required in your jurisdiction). If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account & Access

You may be required to create an account using an email address and one-time password or other authentication methods. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at support@cutland.ai if you suspect unauthorized access.

5. License & Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or lawful commercial purposes. You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to generate harmful, illegal, infringing, or misleading content.
  • Attempt to bypass usage limits, security measures, or access controls.
  • Resell, sublicense, or redistribute the Service or its core software without written permission.
  • Use automated bots or scrapers to access the Service in a manner that degrades performance or violates these Terms.

6. User Content

You retain ownership of all videos, images, audio, transcripts, and other content you upload or create ("User Content"). By using the Service, you grant us a limited license to process your User Content solely to provide the Service functionality (for example, transcription, dubbing, translation, clip generation, and export).

We do not claim ownership of your User Content and will not use it for advertising or to train public AI models without your explicit consent. You represent that you have all rights necessary to upload and process your User Content and that it does not violate applicable law or third-party rights.

7. AI-Generated Outputs

Subtitles, dubs, TTS voiceovers, summaries, hashtags, emphasis suggestions, auto-generated clips, and other AI-generated elements produced by CutLand are provided "as-is." While we strive for accuracy, we do not guarantee that AI outputs are error-free, complete, or suitable for every use case. You are responsible for reviewing outputs before publishing or distributing them.

8. Subscriptions, Credits & Billing

CutLand may offer free features alongside paid subscriptions (such as CutLand Pro) and credit packages. Purchases made through Google Play or the Apple App Store are subject to the respective store's payment terms, billing cycles, and refund policies. We do not store your full payment card details.

9. Privacy & Data

Your use of CutLand is also governed by our Privacy Policy. We collect only the data necessary to operate the Service and do not sell personal information to third parties.

10. Intellectual Property

All trademarks, logos, software, and design elements of CutLand and Wisenux are the exclusive property of Wisenux Inc. or its licensors. Nothing in these Terms grants you rights to use our branding without prior written consent. Third-party music, fonts, stickers, or other licensed assets remain subject to their own license terms.

11. Availability & Changes

We may modify, suspend, or discontinue any part of the Service at any time without liability. We will make reasonable efforts to notify users of material changes to these Terms by updating the effective date on this page.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISENUX INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or one hundred Canadian dollars (CAD $100) if you have not made any payments.

14. Termination

We reserve the right to suspend or terminate your access at our sole discretion if you violate these Terms. Upon termination, your license to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Courts located in Ontario shall have exclusive jurisdiction over disputes arising from these Terms, subject to applicable consumer protection laws.
